Understanding gender recognition in the United States

The US has no federal standard for gender recognition. Each state sets its own rules, creating a complex patchwork of requirements ranging from simple self-attestation to court orders and medical documentation.

Consistent documentation

Our certificate provides the same documentation regardless of which state you live in — processed in 5 working days with no medical requirements.

State-by-state variation

Official requirements vary dramatically. Some states have simple processes, others require court orders or medical documentation, and some have recent restrictions.

Bridging documentation

Many people use our certificate alongside official documents, while processes are underway, or when state barriers make official recognition difficult.

Legal landscape

Why the US is uniquely complex

Unlike countries with national gender recognition laws, the US has no federal standard. Each state controls its own rules for birth certificates, driver’s licenses, and name changes.

What varies by state

  • Birth certificate amendments
  • Driver’s license gender marker changes
  • Name change processes and requirements
  • Required documentation and evidence
  • Court involvement and fees
  • Recognition of non-binary markers

Progressive states

Some states have adopted self-attestation or simplified processes, including:

  • California, Oregon, Washington
  • Colorado, Nevada, New Mexico
  • Illinois, New York, New Jersey
  • Massachusetts, Connecticut, Vermont
  • Many others with simplified requirements

Restrictive states

Some states have more complex requirements or recent restrictions:

  • Court orders required
  • Medical documentation or surgery requirements
  • Limited or no provisions for gender marker changes
  • Recent legislative restrictions in some states

Why this matters

The patchwork of state laws means your experience depends heavily on where you live. Moving between states can complicate documentation, and some people face significant barriers to official recognition. This is why many Americans value consistent, accessible personal documentation.

Official recognition

Federal documents vs state documents

While states control birth certificates and driver’s licenses, some federal documents have their own processes.

Federal documents (consistent nationwide)

US Passports

Can be updated with self-attestation — no medical documentation required since 2022. “X” markers available for non-binary gender.

Social Security

Can be updated with an updated state ID or passport. No additional medical documentation required.

State documents (vary by state)

Birth certificates

Requirements vary dramatically by state. Some allow simple amendments, others require court orders or medical documentation.

Driver’s licenses

State DMV policies vary. Approximately 25+ states now offer “X” markers. Check your state’s current DMV requirements.

Name changes

Typically require court petitions, newspaper publication (in many states), hearings, and fees ($150-500+). Processes vary significantly.

Understanding the difference

What our certificate provides

Clear about what this is and what it isn’t — so you can decide if it’s right for your situation.

Our certificate IS:

  • A formal document recording your self-identified gender
  • Based on self-identification (no medical evidence required)
  • Processed within 5 working days
  • Consistent regardless of which state you live in
  • Suitable for personal use and supporting documentation
  • Recognized internationally within our service regions

Our certificate is NOT:

  • A US government document (federal or state)
  • A replacement for state-level gender recognition processes
  • Valid for changing birth certificates, driver’s licenses, or passports
  • Recognized by US government agencies for official purposes
  • A court order or legal name change document
  • A substitute for official legal recognition
How to use

Where the certificate can help in the USA

Many people use our certificate as supporting documentation with private organizations, particularly in states with complex requirements or while official processes are underway.

Practical usage contexts

Employment

HR records, workplace systems, staff badges — particularly useful before official documents are updated or in private sector roles.

Financial services

Banks, insurance companies, credit providers — acceptance varies by institution. Major national and international banks may accept as supporting documentation.

Education

Universities, colleges, private schools, student records — many institutions accept supporting documentation under internal policies.

Private healthcare

Private clinics, practitioners, health insurance providers, medical records systems.

Memberships & services

Gyms, clubs, professional associations, subscription services — private organizations with policy-based approaches.

Bridging documentation

While official state processes are underway (which can take months), or when moving between states with different requirements.

What the certificate typically cannot be used for

  • Birth certificate amendments
  • Passport applications (use federal self-attestation process)
  • Driver’s license updates (follow state DMV requirements)
  • Social Security record changes
  • Federal employment records
  • Immigration matters
  • Court proceedings
  • Military records

Why it’s valuable in the US

Our certificate provides consistent documentation that doesn’t change when you move states. It’s particularly valuable for:

  • Those in restrictive states facing barriers to official recognition
  • Bridging documentation while state processes are underway
  • Private sector use where official documents aren’t required
  • Personal affirmation and immediate documentation
Name changes

Important note for US residents

If you want to legally change your name in the United States, you must follow your state’s court process — not use a UK deed poll.

⚠️ UK deed polls are not recognized for US legal name changes

UK deed polls are a legal mechanism specific to UK common law. They are not recognized for legal name changes in the United States.

US name change process

Name changes in the US typically require:

  1. Filing a petition with your local court
  2. Publishing notice in a newspaper (in many states)
  3. Attending a court hearing
  4. Receiving a court order
  5. Updating your documents with the court order

Costs and requirements vary by state — typically $150-500+ in court fees, plus publication costs. Some states allow name changes as part of gender marker change processes.

Our recommendation for US residents

If you’re only purchasing our certificate for use in the USA, we recommend the Essential ($89) or Standard ($129) packages. The deed poll service we offer is specifically for UK residents and won’t help with US legal name changes.

FAQs

Common questions for the USA

Quick clarity on what this does (and doesn’t) do in the United States.

Why would I use your certificate when state requirements vary so much?
Our certificate provides consistent documentation regardless of which state you live in or whether state requirements are simple or complex. Common reasons include: wanting immediate documentation (5 working days vs. months), privacy preferences, facing barriers in restrictive states, bridging documentation while official processes are underway, or consistent documentation when moving between states.
I live in a state with restrictive laws. Is this a workaround?
Our certificate is personal documentation, not a substitute for state legal recognition. However, it can provide formal acknowledgment of your identity when official recognition is difficult or impossible to obtain in your state. Many private organizations may accept it as supporting documentation under their internal policies.
Can I use this to change my US passport?
No — but the good news is that US passports can now be updated through self-attestation (no medical documentation required since 2022). Our certificate is separate from and doesn’t affect the passport process. Use the State Department’s official process for passport updates.
Will American banks accept this?
Acceptance varies by institution. Major national banks and international banks may accept it as supporting documentation under their policies. We recommend checking with your specific bank’s requirements and policies.
I’m moving between states. Does this help?
Yes. Our certificate provides consistent documentation that doesn’t change when you move. Your state-level documents may have different statuses in different states, but our certificate remains the same and can help with private organizations during transitions.
Can I use this for a legal name change in the US?
No. Legal name changes in the US require following your state’s court process. UK deed polls (which some of our packages include) are not recognized for US legal name changes. If you only need documentation for US use, we recommend the Essential or Standard packages without the deed poll option.
Do you serve US territories?
Yes. We serve residents of all US states and territories including Puerto Rico, Guam, US Virgin Islands, American Samoa, and Northern Mariana Islands.
What’s the Standard + Preferred Name bundle?
The Standard + Preferred Name package ($169) includes both your Gender Recognition Certificate and Preferred Name Certificate — both printed and digital versions, with shared Digital Registry access. Available as Package 3 for non-UK regions.
