Terms of Service

These Terms explain how GenderRecognition.org works, what you’re purchasing, and the limits of our responsibility. Please read them carefully before ordering.

1. Introduction

These Terms of Service (“Terms”) govern your use of GenderRecognition.org (the “Website”) and the products and services provided by GenderRecognition.org (“we”, “us”, “our”).

By accessing the Website, submitting an application, or purchasing any product or service, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Website or our services.

2. Nature of the Service

GenderRecognition.org provides private, non-governmental documentation services intended for personal use and, where applicable, use with private organisations.

Our services do not provide government-issued identification, legal gender recognition, automatic changes to official records, or legal advice.

Acceptance of our documentation is not guaranteed and depends on third-party policies and local law.

3. Eligibility

  • You must be 18 years of age or older.
  • You must have the legal capacity to enter into a binding contract.
  • You must provide accurate and complete information when applying or ordering.

We reserve the right to refuse service where eligibility requirements are not met or where misuse, fraud, or unlawful activity is suspected.

4. Products and Services

4.1 Certificates

We issue private certificates that record a self-declared gender identity. Certificates are issued based on self-identification and do not require medical evidence.

  • Certificates are not government documents.
  • Certificates do not confer legal gender recognition.
  • Certificates do not change any official record.

4.2 Digital Registry

Eligible certificate packages include one (1) year of Digital Registry access at no additional cost. Registry access may include secure record storage, verification via reference number, and access to digital copies.

After Year 1, registry access may be renewed annually for a stated fee. Renewal is optional. If you do not renew, your certificate remains valid, but certain Digital Registry features may be unavailable until re-activated.

4.3 Printed Certificates

Where selected, printed certificates are produced and delivered by post. Delivery times are estimates and are not guarantees.

4.4 UK Deed Poll (UK Residents Only)

Where offered, a UK deed poll is a name-change document governed by UK law. We do not represent or guarantee that a UK deed poll will be accepted outside the UK or for legal name changes in non-UK jurisdictions.

4.5 Extended Registry Bundles (Non-UK)

For customers outside the UK, certain packages may include prepaid extended Digital Registry access. These bundles are offered as a convenience and do not change the legal status or nature of the certificate.

5. Orders, Pricing, and Payment

5.1 Payments

Payments are processed securely via Stripe. We do not store card details.

5.2 One-off payments

Certificates and associated documents are provided for a one-off payment. Digital Registry renewals (where applicable) are optional recurring charges.

5.3 Currency

If prices are displayed in multiple currencies, this may be for clarity only. Payment processing may occur in a primary billing currency, and your bank may apply exchange rates or conversion fees.

6. Fulfilment and Processing

Processing times are estimates only. Delays may occur due to incomplete information, verification requirements, postal services, or circumstances outside our control.

We are not responsible for delays caused by third parties, including delivery carriers, banks, or payment processors.

7. Accuracy of Information

You are responsible for ensuring the information you submit is accurate, complete, and correctly spelled.

We are not responsible for errors caused by incorrect information you provide. Corrections may require additional processing time and may incur a fee.

8. No Legal Advice

Nothing on this Website or in our communications constitutes legal advice. For advice specific to your situation, consult a qualified legal professional.

9. Acceptance and Use of Documents

We do not guarantee acceptance of our documents by any third party, including governments, courts, employers, banks, educational institutions, or service providers.

Use of the documents is entirely at your discretion and risk. You agree not to misrepresent any document as government-issued or legally determinative where it is not.

10. Refund Policy

Our services involve personalised documents created for the individual named on the order. Once processing begins, refunds are limited.

  • No “change of mind” refunds once your application has been submitted and processing has started.
  • Digital documents and Digital Registry activation are non-returnable once supplied.
  • If we make an error, we will correct it and reissue your documents at no additional cost.

11. Intellectual Property

All content, designs, documents, and materials provided by us are our intellectual property (or licensed to us) and are protected by applicable laws.

You may not reproduce, distribute, resell, or commercially exploit our materials without our prior written permission.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, loss of opportunity, loss of reputation, or third-party decisions (including refusal to accept documents).

Our total liability for any claim arising from or relating to your order or use of the services shall not exceed the amount you paid for the specific service giving rise to the claim.

Nothing in these Terms limits or excludes liability where it cannot be limited or excluded under applicable law.

13. Indemnity

You agree to indemnify and hold us harmless from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your misuse or misrepresentation of documents
  • Your violation of any applicable law or third-party rights
  • Disputes between you and a third party relating to your use of the service

14. Suspension and Termination

We may suspend or terminate access to services (including Digital Registry access) where we reasonably believe there has been misuse, fraud, unlawful activity, or breach of these Terms.

Suspension or termination does not affect any rights or obligations accrued prior to that action.

15. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place your order will apply to that order.
